Terms and Conditions
1. Definitions
In these conditions of sale all references to ‘the seller’ are to SimplyMed and all references to ‘the buyer’ are to the person, firm, company or by whom the order is given. All the references to ‘the goods’ are to any items supplied by the Seller and to the Buyer.
2. Specification
Every effort is made to ensure that the catalogue descriptions and illustrations are clear & accurate. All colours may vary and sizes are approximate. The reproductions of colours is as accurate as photographic printing processes will allow. Due to our policy of continual improvement some products may vary from those described. The company reserves the right to amend the specification, construction and/or design without prior notice.
3. Prices
All prices are subject to alteration without prior notice. VAT is charged at the current rate unless a VAT exemption certificate / or signed VAT Exemption form (which we can provide) is with the order.
4. Delivery
Normal delivery is usually within 2 working days from the receipt of order. If you would like to use a ‘Next Day Guaranteed’ service please contact customer services before placing your order.
The company are entitled to make part deliveries, by instalment and each delivery will be treated as a separate sale and invoiced accordingly.
We cannot deliver to PO Boxes.
Please note that days quoted are working days.
5. Carriage charges.
Will vary dependent upon weight/bulk of order and is subject to change without prior notice.
6. Order Cancellation.
All cancellation of orders must be in writing with our prior agreement within 5 working days from order date. We are unable to accept cancellation of specially ordered, non-stock items.
7. Payment Terms.
Unless there is evidence in writing to the contrary payment shall be in made in advance of delivery of all orders.
8. Return of Goods Policy.
To return an item:
If for any reason You are not completely satisfied with your purchase from Simplymed ltd, please notify us at [email protected] or call 01942 243999 within a reasonable time (usually 7 days from delivery) to arrange a return.
Simplymed Ltd will then arrange to have the package(s) collected by a nominated carrier and delivered to Simplymed Ltd.
After contacting the customer services department You need to:
- re-package the product(s) in their original boxes along with the despatch note (or order acknowledgement) stating the reason for the return. In the case of a defective product, please provide a full description of the fault;
- make sure You wrap the package securely;
- label the package(s) with your reference number and collection reference number that will be supplied to you by the customer service representative.
If the goods are returned due to an error made by Simplymed Ltd or if the goods are faulty, we will replace where possible or refund the cost in full (including the purchase price of the goods and original delivery costs).
However, if the goods are returned for any other reason, Simplymed Ltd will only refund the purchase price paid for the goods excluding the original delivery costs and You will need to pay for the return delivery costs.
If a non-faulty product returned is not in fully resalable condition or the packaging is damaged, we reserve the right to refuse a full refund on the item.
Refunds will only be made once the returned Products are received by us and inspected
Please note, items purchased from the Simplymed Ltd website can only be returned directly to not to subsidiaries, independent retailers, concessions, stockists of Simplymed Ltd
This returns policy does not affect your statutory rights.
9. Loss or Damage
Any loss, damage or shortage must be notified within 3 working days or confirmed in writing within 7 days. Claims outside these times will not be accepted.
10. Description.
The company is continually seeking to improve the quality and value of its goods and services. Whilst every care is taken to ensure illustrations and descriptions are accurate and informative, we do reserve the right to change specifications and improve our products. In the event of substitute products not being acceptable, we will issue a full credit, provided the goods in question are returned in a new, re-saleable condition and in-line with our Return of Goods Policy, outlined.
11. Warranty
All equipment and services provided by SimplyMed, its agents and contractors, is covered by a one year warranty against faulty workmanship (with the exception of customer misuse).
(The warranty is 6 months on certain items in our range; if you are unsure please contact our customer services team prior to placing your order).
However, in the event where a call is found to be unrelated to the company’s products or services or where the fault is of customer misuse, a charge will apply, details supplied on request. All materials required are at extra current prices.
All prices are subject to VAT at the current rate.
The company warrants that the goods shall at the time of delivery correspond to the specifications published by the company when used for purposes for which goods of that type are ordinarily used. In the absence of any such published specifications applicable to the Goods, the Company warrants that the goods shall at the time of delivery be of merchantable quality. If any goods do not conform to that warranty the Company will as its option: i) replace the goods found not to conform to the warranty, ii) bring the Goods into conformity with the published specifications of the company, (or as the case may be) merchantable quality, iii) take back the Goods found not to conform to the warranty and refund the appropriate part of the purchase price.
All claims must be made in writing to the customer service department (see item 8), accompanied by proof of purchase and details/nature of defect.
12. Reservation of Title
Title of goods does not pass until full invoice has been paid.
13. Disclaimer Notice.
Every endeavour has been made to ensure that the information given herein is true and reliable but is given only as guidance to our customers. The company cannot accept any responsibility for the loss or damage that may result from the use of the information due to the possibility of variations of processing or working conditions and of workmanship outside our control. Users are advised to confirm the suitability of products by their own tests.
